Terms of Service

1. Acceptance of Terms
By downloading, installing, or using the Bevvies mobile application ("App"), or by using the bevvies.app website ("Website") — together, the "Services" — you agree to be bound by these Terms of Service ("Terms"). References to the App in these Terms include the Website where applicable. If you do not agree to these Terms, do not use the Services.
These Terms constitute a legally binding agreement between you and Jacob McCullum trading as Bevvies ("we", "our", or "us").
2. Eligibility
You must be at least 18 years of age to use the App. By creating an account, you confirm that you are 18 years of age or older. We reserve the right to terminate accounts found to belong to users under 18.
The App is intended for use in Australia. Use of the App outside Australia is at your own risk and we make no representation that the App complies with the laws of any other jurisdiction.
3. Your Account
3.1 Account creation
You must provide accurate and complete information when creating your account, including your real date of birth. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
3.2 Username
Your username is your public identity on the App. You must not choose a username that impersonates another person, is offensive, or violates any third-party rights. We reserve the right to require you to change your username at our discretion.
3.3 Account security
You must notify us immediately if you suspect unauthorised access to your account. We are not liable for any loss resulting from unauthorised use of your account.
4. Acceptable Use
You agree not to use the App to:
- Submit false, misleading, or fabricated check-ins, venue data, ratings, or reviews
- Harass, abuse, threaten, or intimidate other users
- Post content that is offensive, defamatory, discriminatory, or unlawful
- Spam or repeatedly post the same content
- Impersonate another person or entity
- Use automated means to access, scrape, or interact with the App
- Attempt to gain unauthorised access to the App or its underlying systems
- Engage in any activity that interferes with or disrupts the App
- Violate any applicable law or regulation
We reserve the right to remove content that violates these rules and to suspend or terminate accounts of users who breach these Terms.
5. User-Generated Content
5.1 Your content
The App allows you to submit content including check-ins, ratings, reviews, venue edits, challenge data, and profile information ("User Content"). You retain ownership of your User Content, but by submitting it you grant us a non-exclusive, worldwide, royalty-free licence to use, store, display, and distribute your User Content in connection with operating and improving the App.
5.2 Content standards
Your User Content must be accurate to the best of your knowledge, must not infringe the rights of any third party, and must comply with our Acceptable Use policy above.
5.3 Content moderation
We reserve the right to remove any User Content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable. We are not obligated to monitor all User Content but may do so at our discretion.
6. Venue Data
Venue information in the App is sourced from Google Places API and from User Content submitted by the community. While we take steps to maintain accuracy, we cannot guarantee the accuracy, completeness, or currency of venue data including opening hours, pricing, and tap lists. Always verify venue information independently before visiting.
7. Subscriptions
7.1 Free tier
The App is available free of charge with access to core features as described in the App.
7.2 Bevvies Pro subscription
Premium features are available through a paid subscription, Bevvies Pro ("Pro"), offered as monthly or annual plans. Subscription pricing and features are displayed in the App and may change from time to time with notice. Verified Author status is a trust level granted by us to selected contributors — it is not a paid subscription and cannot be purchased.
Subscriptions are billed through Apple's App Store on iOS or Google Play on Android. Payment will be charged to your Apple ID or Google account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your Apple ID or Google Play account settings.
7.3 Refunds
All subscription purchases are subject to the refund policy of the store you purchased through. We do not control refunds for in-app purchases. Please contact Apple Support or Google Play support for refund requests. Nothing in this section limits your rights under the Australian Consumer Law.
7.4 Changes to pricing
We reserve the right to change subscription pricing. We will provide reasonable notice of any price changes. Continued use of the subscription after the price change takes effect constitutes acceptance of the new price.
8. Challenges and Points
The challenges, points, and badges system within the App is provided for entertainment and engagement purposes only. Points, badges, and challenge completions have no monetary value and cannot be redeemed for cash or any other reward. We reserve the right to modify, reset, or remove the points and badges system at any time.
Challenge completion is based on self-reporting and community verification. We are not responsible for disputes between users regarding challenge completions.
9. Alcohol and Responsible Service
Bevvies is designed for users who are 18 years of age or older. The App promotes the discovery of licensed venues and is intended to be used responsibly. We encourage all users to drink responsibly and in accordance with applicable laws.
We do not endorse excessive alcohol consumption. We are not responsible for any harm, injury, or loss resulting from alcohol consumption by users of the App.
Challenges such as pub crawls and pub golf are optional social activities. Participation is voluntary and entirely at your own risk. You are responsible for drinking within your own limits, complying with venue rules and applicable liquor laws, and arranging safe transport — never drink and drive. Challenges must not be used to pressure others to drink or to encourage excessive consumption.
10. Intellectual Property
All intellectual property in the App including the Bevvies name, logo, design, code, and original content is owned by us or our licensors. You must not copy, reproduce, modify, or distribute any part of the App without our prior written consent.
Third-party content including venue data from Google Places remains the property of its respective owners.
11. Disclaimers
The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
To the maximum extent permitted by Australian law, we disclaim all warranties including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including but not limited to loss of data, loss of revenue, or personal injury.
Nothing in these Terms limits any rights you may have under the Australian Consumer Law or other non-excludable consumer protection laws.
13. Indemnity
You agree to indemnify and hold us harmless from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected with your User Content, your use of the Services, or your breach of these Terms or any applicable law.
14. App Store Terms
The App is distributed through Apple's App Store and Google Play. Apple and Google are not parties to these Terms, have no obligation to provide maintenance or support for the App, and are not responsible for addressing any claims relating to the App. To the extent permitted by law, Apple and Google (and their subsidiaries) are third-party beneficiaries of these Terms and may enforce them against you.
Your use of the App must also comply with the terms of service of the app store from which you downloaded it.
15. Termination
We may suspend or terminate your account at any time if we believe you have violated these Terms or for any other reason at our discretion. You may delete your account at any time through the App settings.
Upon termination, your right to use the App ceases. Sections of these Terms that by their nature should survive termination will continue to apply.
16. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, by in-app notification. Continued use of the App after changes constitutes acceptance of the updated Terms.
17. General
If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision. You may not assign your rights under these Terms without our prior written consent; we may assign our rights in connection with a business transfer. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Services.
18. Governing Law
These Terms are governed by the laws of Australia. Any disputes arising from these Terms or your use of the Services will be subject to the exclusive jurisdiction of the courts of Australia.
